Municipalities are required to allow the operation of cannabis retail businesses licensed by the state. Once the state license is issued, the city will regulate these businesses locally through a local business registration. At least once a year, cities are required to conduct compliance checks of every cannabis and hemp business.

Brooklyn Center is required by statute to allow at least one cannabis retail business registration for every 12,500 residents, which, based on the current population, is capped at a maximum of three (3) registrations.

Zoning and Location for a Cannabis Retail Business

Under State Statute 342, local governments play a critical role in the licensing process, serving as a final approval for a cannabis retail business nearing award of a State license from the OCM. Once the applicant is selected by OCM to proceed, the applicant is required to receive the city’s certification of zoning compliance and be approved for local registration before operations may commence.  It is important to contact the Community Development Department, Planning and Zoning, to verify that the location is in compliance with ordinance requirements and state law.

Business Registration

In order to apply for retail registration, an applicant must have secured their preliminary approval from the OCM. Brooklyn Center will be holding a lottery for those who have completed the preliminary OCM approval process, local registration, and submitted all of the necessary paperwork in order to be included in the lottery. The first lottery will select one applicant.

All other applications will be closed and the funds returned unless the applicant asks to be kept open until the next lottery. The second lottery will be held 90 days from the conclusion of the first lottery if there are still open applications, or 90 days from when a valid application is received. The third lottery will be held following the same standard.
